Cluetide AI Terms of Service

These Terms of Service ("Terms") govern your access to and use of Cluetide AI (the "Service"). By creating an account, you agree to these Terms.

Cluetide AI is a product of Crescent Solutions Inc., a corporation incorporated in Alberta, Canada. References to "we," "us," and "our" throughout these Terms refer to Crescent Solutions Inc.

1. The Service

Cluetide AI monitors channels you connect and authorize, uses AI to analyze and score customer conversations, and provides tools to help you respond to and act on them.

2. Eligibility

You must be at least 18 years old and have authority to bind the business you register on behalf of.

3. Your Account

• You are responsible for maintaining the security of your login credentials
• You are responsible for the accuracy of information you provide
• You must notify us promptly of any unauthorized use of your account

4. Connected Channels

• You represent that you have the legal right to connect and authorize access to any channel/account you connect to Cluetide AI (e.g., you are the owner or authorized administrator of the connected Instagram, Facebook, TikTok, or other account)
• You are responsible for complying with the terms of service of each third-party platform you connect
• You may disconnect any channel at any time

5. AI-Generated Content

• Cluetide AI uses AI to generate suggested replies, summaries, scores, and marketing content
• AI-generated content may contain errors or inaccuracies; you are responsible for reviewing content before sending or publishing it
• Lead scores and AI estimates are provided for informational purposes and do not guarantee sales outcomes

6. Subscription & Billing

• Fees are billed according to your selected plan (Free Trial, Starter, Professional, Premium AI Intelligence, Enterprise)
• Subscriptions renew automatically unless cancelled before the renewal date
• Usage-based overage charges (e.g., additional AI credits, mention volume) apply per your plan's terms

7. Acceptable Use

You agree not to: - Use the Service to violate any law or third-party platform's terms of service - Attempt to access data or accounts you are not authorized to access - Reverse-engineer, scrape, or interfere with the Service's operation - Use the Service to harass, spam, or send unsolicited content to third parties

8. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect data.

9. Intellectual Property

• We retain all rights to the Service, including its software, design, and underlying technology
• You retain ownership of your business data and content you upload

10. Termination

• You may cancel your subscription and request deletion of your account at any time (see our Data Deletion Instructions)
• We may suspend or terminate accounts that violate these Terms or applicable law

11. Disclaimers

The Service is provided "as is." We do not guarantee uninterrupted availability, and AI-generated insights are estimates, not guarantees of business outcomes.

12. Limitation of Liability

To the maximum extent permitted by law, Cluetide AI is not liable for indirect, incidental, or consequential damages arising from use of the Service.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated in advance.

14. Governing Law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree to submit to the exclusive jurisdiction of the courts located in Alberta, Canada for any disputes arising from these Terms.
